1. Validity

These general terms and conditions apply to all orders and deliveries from Contrada USA. As a buyer, you accept our following general terms and conditions (GTC) as soon as you place an order. The contract language is English.

2. Quotation & Order

The presentation of the products on this website does not give rise to any entitlement to an order, but merely a request to order. However, goods may be sold out or removed from the range. Errors, shortages or delivery problems can always occur.

The contract is concluded as soon as the "Buy" button is clicked. Before that, there is no entitlement to delivery of the goods. We reserve the right not to accept incoming orders for certain reasons. As soon as we accept receipt of the order and you receive an order confirmation by e-mail, a sales contract is formed.

The ordered goods remain our property until payment has been made by the buyer. The prices stated on the website, as well as verbal or written explanations of prices, only apply if we have expressly referred to them in the purchase confirmation.

The presentation of goods in the online shop may differ from the actual product. This applies in particular to the color of the product, which can vary due to various factors, such as screen settings or the exposure of the product photograph.

The prices apply according to the information in our online shop at the time of the order and include VAT. All prices are shown in Dollars. In addition to the price of the goods, there is also the price for delivery and transport and any customs duties, other taxes and duties. Shipping costs vary based on distance and quantity ordered. The shipping costs are calculated when ordering the goods.

In the case of special orders, in particular with regard to colors and sizes other than those available in the online shop, it may be that we have to calculate special prices depending on the effort involved, which may deviate from the sales price in the online shop. For special orders, we will send you a concrete offer via e-mail.

3. Payment

You can pay for your ordered products at the checkout in our online shop via credit card (VISA, Mastercard or American Express) or Paypal, GooglePay or ShopPay.

For special orders, please send us an e-mail info @ contradashop . com and we will contact you if we can fulfill your request. For special orders, the payment amount must be transferred our bank account and we will send you an invoice by email after your order has been confirmed.

We can refuse certain orders without giving reasons or insist on payment by cash on delivery or prepayment.

4. Transportation & Delivery

Orders via our online shop are delivered by various carriers such as UPS, USPS, FedEx, and DHL.

Within the United States the order including production and shipping takes up to a maximum of 7-10 working days. 

Outside of the United States delivery can take up to 14 working days. The actual transport costs incurred will be charged depending on the destination.

Unfortunately, we cannot guarantee the shipping times, as these times may vary in exceptional cases. If the product has not been delivered after 10 working days, please contact us at info@contradshop.com and we will investigate the matter.

The transport costs are shown as soon as you enter your delivery address during the ordering process.

If an ordered product is not in stock and there are major delays, we will inform you immediately about the estimated delivery time.

If the delivery address provided is unclear or insufficient, we unfortunately cannot take any responsibility for delay or missed delivery.

Please note that for deliveries outside the United States, customs tariffs may be charged. Any customs duties must be borne by you as the buyer.

5. Right of Withdrawal & Returns

The right of withdrawal only applies to our standard range. In the case of custom-made products, we can unfortunately no longer take back the goods. With our standard range, you have the right to withdraw from the purchase contract within 14 days of receipt of the goods without giving reasons in text form (letter or email). If the right of withdrawal applies, all mutually received services must be refunded. We will refund all included costs and fees that we have received from you and you send us the received product within 30 days from the effective date of the right of withdrawal to our address:

The costs for the return are borne by you.

If you would like to exchange a product for a different size, please proceed as described above. We will refund you the money and you can order the product again in the new size.

Unfortunately, we can no longer take back textiles that have been worn (with the exception of fittings), soiled, washed or dry-cleaned.

Reduced goods, such as products that are on sale or products that were ordered with a discount code, are also non-returnable.

6. Transport damage

When you receive the goods, it is important that you check them in the presence of the postman to ensure that the package is undamaged. Our products are subject to strict quality control before shipping, so we can rule out that the goods have been damaged or soiled by us. If the package is opened or torn, do not accept it, otherwise you will be implicitly confirming a damage-free delivery.

7. Defects

Differences between the colors shown on the website and the actual colors of the goods are of a technical nature and can occur due to the color reproduction on your computer and therefore do not constitute a defect. We do not guarantee this. That the colors displayed on our website correspond to the actual colors of the products.

If you do not inform us immediately about obvious defects, you lose your warranty claim. Please contact us immediately if the goods contain an obvious defect.

We cannot accept liability if goods have not been cleaned in accordance with the care instructions. Our textiles should be washed at a maximum of 30° degrees and should not be tumble dried. The care instructions are in our FAQs on how to wash the textiles.

8. Retention of title

The goods remain our property until you have paid in full.

9. Severability Clause

If one or more provisions of these general terms and conditions are or become invalid, this does not affect the validity of the remaining general terms and conditions. If you have any questions about our terms and conditions, simply send us an email to: info@contradashop.com 

10. Data Protection

The data that we receive from you (e-mail address, address, name, contact person, ordered goods) will only be used to successfully complete the transaction.

For technical reasons, we may store the data on a cloud server, which is not accessible to third parties.

11. Liability

When creating the content on our website, we ensure that it is correct, complete, quality and up-to-date, but we cannot assume any liability for this. When using the website, liability claims against us relating to material or immaterial damage due to the use of any incorrect or incomplete content are generally excluded, provided that it is not a matter of intentional or grossly negligent fault on our part.

The content offered is non-binding and subject to change. We reserve the right to adapt or delete the website in whole or in part without prior notice.

Our website contains links to third-party websites over which we have no control. We assume no liability for the content of these websites, since the operators of these websites are responsible for their content. At the time of linking, there were no illegal links to third-party websites. As soon as we become aware of an infringement, this content will be removed from our site immediately.

12. Final Provisions

You cannot transfer your rights to third parties.

Austrian law is applied. Even if you act as a company or foundation that does not normally fall under the jurisdiction of an Austrian court, our place of business in Vienna is the place of performance of the binding business contract and therefore any disputes will be decided by the competent court in Vienna.

If any part of these general terms and conditions is found to be invalid by a court, this shall not affect the remaining provisions of these terms and conditions. These remain fully effective.
